Regulatory Framework: Canada Revenue Agency (CRA) Directives; Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA/FINTRAC); Personal Information Protection and Electronic Documents Act (PIPEDA); Canada Evidence Act.
1. PURPOSE & CORPORATE MANDATE
Bizoso Consulta operates within a highly regulated international framework. This Master Data Retention Policy establishes the mandatory legal timelines for which we must retain Client records, financial data, and digital metadata.
Our retention schedules are not optional. They are engineered to ensure absolute compliance with Canadian federal tax laws, international Anti-Money Laundering (AML) statutes, and to preserve an unalterable evidentiary audit trail to protect the Company from malicious litigation or chargeback fraud.
2. SCOPE OF RETENTION (THE DIGITAL AUDIT TRAIL)
This policy governs all digital records generated, uploaded, or transmitted through the Bizoso Consulta infrastructure. This includes, but is not limited to:
- Submitted Documentation: Passports, corporate registry forms, bank statements, and educational records.
- Financial Metadata: Invoices, digital payment receipts, and payment gateway token logs.
- Cryptographic Evidence: Under the Canada Evidence Act, we retain CRM-generated Public IP addresses, login timestamps, and electronic signature logs to enforce "Non-Repudiation" (preventing a Client from falsely claiming they did not execute a contract).
3. STATUTORY RETENTION SCHEDULES
Bizoso Consulta does not hold data indefinitely, nor do we delete it prematurely. The following retention schedules are mandated by federal law and corporate policy:
A. Financial & Billing Records (The 7-Year CRA Mandate)
- Data Included: Invoices, billing histories, signed Master Terms of Service, digital transaction receipts, and AML verification logs.
- Retention Period: Exactly Seven (7) Years from the date of the financial transaction.
- Statutory Justification: Mandatory compliance with the Canada Revenue Agency (CRA) for corporate tax auditing and FINTRAC for anti-money laundering investigations.
B. Operational Application Files (The 90-Day Purge Protocol)
- Data Included: Uploaded identity documents, resumes, drafted business plans, and compiled visa/permit application packets.
- Retention Period: Exactly Ninety (90) Days following the final conclusion of the Client's case (e.g., successful corporate formation, visa decision, or contract abandonment).
- Corporate Justification: Bizoso Consulta is an administrative processing firm, not a permanent cloud storage provider. We aggressively purge sensitive application data to mitigate cyber-risk and limit data exposure.
4. EXCEPTIONS TO DELETION: THE "LEGAL HOLD" MANDATE
The retention schedules listed above are standard minimums. Bizoso Consulta will instantly suspend all automated data destruction protocols and place a Client’s entire digital file on an indefinite "Legal Hold" under the following strict triggers:
- Financial Disputes: The Client has initiated a credit card chargeback, bank reversal, or payment dispute.
- Fraud Detection: The Client is under internal or external investigation for submitting forged documents, utilizing stolen financial data, or misrepresentation.
- Active Litigation: The Client has threatened or initiated civil litigation against Bizoso Consulta.
- Law Enforcement Subpoena: The RCMP, CBSA, FBI, UK Border Force, or any sovereign agency has formally requested the preservation of the Client's records.
Under a Legal Hold, data will be retained indefinitely until the legal matter, financial dispute, or criminal investigation is entirely resolved and the Company is formally cleared of liability.
5. LIMITATIONS ON THE "RIGHT TO ERASURE" (ANTI-SPOILATION)
Under PIPEDA, clients possess certain rights regarding their data, including the right to request deletion. However, Bizoso Consulta strictly enforces the legal limits of these rights.
- Denial of Erasure: The Client legally concedes that the "Right to be Forgotten" cannot be weaponized to destroy evidence. If a Client’s data falls within the mandatory 7-Year CRA retention period, or if their file is under a Legal Hold for fraud or a chargeback, any request to delete their account or purge their documents will be categorically denied. * Lawful Deletion: If no statutory hold applies and the operational relationship has concluded, lawful clients may request early erasure of their non-financial operational data via a formal portal ticket, which will be processed within 30 business days.
6. SECURE DESTRUCTION PROTOCOL
Upon the strict expiration of the required statutory retention period, Client data is destroyed with absolute finality.
- Digital Eradication: Client files, identity scans, and CRM profiles are permanently wiped from our secure servers using cryptographic overwriting protocols, ensuring the data cannot be recovered by forensic software.
- No Archival Retrieval: Bizoso Consulta does not maintain hidden archival backups of purged client files. Once the 90-Day Purge is executed, the Client is solely responsible for retaining their own copies of their corporate or travel documents. We cannot retrieve purged files.
7. BINDING ACKNOWLEDGMENT
By utilizing Bizoso Consulta’s global portal, executing a digital signature, or remitting payment for our administrative services, the Client explicitly acknowledges, understands, and legally accepts the statutory data retention and destruction timelines outlined in this protocol.
