Effective Date: Dec 10, 2024
Corporate Identifiers: 🇨🇦 BN: 791892613 | 🇺🇸 EIN: 98-1906505 | 🇬🇧 UK: 16666993
Governing Jurisdiction: Province of Ontario, Canada
Regulatory Framework: Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA); FINTRAC Directives; Personal Information Protection and Electronic Documents Act (PIPEDA).

1. ABSOLUTE CORPORATE MANDATE

Bizoso Consulta Canada operates under the highest echelon of corporate compliance. We do not facilitate anonymous B2B transactions, nor do we process sovereign visa applications for unverified individuals. This Master KYC Policy is the impenetrable first line of defense against identity theft, financial fraud, money laundering, and terrorist financing. Passing our KYC clearance is a mandatory, non-negotiable prerequisite before any administrative labor is commenced.

2. MANDATORY IDENTITY ACQUISITION (THE "DIGITAL ONLY" PROTOCOL)

Consistent with our 100% digital, "No Walk-In" corporate infrastructure, Bizoso Consulta conducts all identity verification remotely through our cryptographically secure CRM portal. We collect only the data strictly necessary to satisfy FINTRAC guidelines and sovereign embassy requirements.

  1. Individual Clients: Must upload high-resolution scans of unexpired, biometric, government-issued photo identification (e.g., Passport or National ID), accompanied by a verifiable proof of residential address (e.g., recent utility bill or certified bank statement).
  2. Corporate Clients & UBOs: Must provide certified Articles of Incorporation, active commercial licenses, and the mandatory, unredacted identification of all Ultimate Beneficial Owners (UBOs) who control 25% or more of the corporate entity.
  3. Prohibition of Unsecured Transmission: Clients are strictly prohibited from emailing unsecured passport scans to staff. All KYC documentation must be uploaded directly to the encrypted CRM gateway.

3. ENHANCED DUE DILIGENCE (EDD) & RISK TRIAGE

Bizoso Consulta actively assesses the risk profile of every client utilizing our digital infrastructure based on geographic origin, transaction volume, and service type.

  1. High-Risk Triggers: Clients originating from flagged, high-risk sovereign jurisdictions, or individuals identified as Politically Exposed Persons (PEPs), are immediately subjected to Enhanced Due Diligence (EDD).
  2. Source of Wealth Verification: Under EDD, the Client is legally required to provide certified, audited proof of the legitimate source of their funds and personal wealth.
  3. Right of Refusal: Bizoso Consulta reserves the absolute, unilateral right to freeze portal access and terminate any contract if a Client refuses to comply with EDD requests or fails to adequately prove the lawful origin of their finances.

4. ZERO-TOLERANCE FOR FORGERY (THE "FRAUD EXCEPTION")

Attempting to bypass our KYC protocols utilizing fabricated identities is a severe federal crime that instantly voids all corporate privacy protections.

  1. Instant Contract Severance: If our compliance auditors detect photoshopped passports, forged utility bills, altered corporate registries, or stolen identities, the Client’s file will be instantly terminated. All fees paid to date will be permanently retained as Liquidated Damages.
  2. The Law Enforcement Handoff: Under our corporate "Fraud Exception," Bizoso Consulta will proactively package the forged KYC documents alongside the Client’s unalterable IP tracking metadata and surrender this evidence directly to federal law enforcement (e.g., the RCMP, FBI, or CBSA) and FINTRAC to protect our corporate integrity.

5. SOVEREIGN REPORTING & THE "NO TIPPING OFF" RULE

Bizoso Consulta is legally bound by federal statutes to report suspicious behavior, regardless of client confidentiality.

  1. Suspicious Transaction Reports (STRs): If a Client’s identity cannot be verified, or if they attempt to utilize mismatched credit cards that conflict with their KYC profile, our Compliance Officer will silently file an STR directly with FINTRAC.
  2. Legal Gag Order: Under Canadian federal law, Bizoso Consulta staff are strictly prohibited from informing, warning, or "tipping off" the Client that their KYC profile has triggered an STR or a federal investigation.

6. THE 7-YEAR EVIDENTIARY RETENTION SCHEDULE

Bizoso Consulta retains KYC data not for commercial use, but for mandatory legal compliance.

  1. Statutory Retention: As mandated by the Canada Revenue Agency (CRA) and FINTRAC, all collected KYC documentation, identity scans, and compliance risk assessments are securely retained in an encrypted state for exactly seven (7) years following the completion of the commercial relationship.

7. CONDITIONAL CLIENT RIGHTS (ANTI-SPOILATION)

While Clients possess data rights under PIPEDA, these rights cannot be weaponized to destroy KYC evidence.

  1. Access and Correction: Lawful clients may request access to their KYC data or update expired passports via a formal portal ticket.
  2. Denial of Erasure: The Client legally concedes that they cannot demand the deletion of their KYC records if they fall within the mandatory 7-year CRA retention period, or if their account is placed on a "Legal Hold" due to a detected forgery or financial chargeback dispute.

8. EMPLOYEE ACCOUNTABILITY & INTERNAL COMPLIANCE

Bizoso Consulta ensures absolute internal adherence to this protocol through an appointed Corporate Compliance Officer.

  1. Mandatory Audits: The Compliance Officer continuously audits the CRM to ensure no file progresses without verified KYC clearance.
  2. Staff Liability: Any employee or case manager found intentionally bypassing KYC protocols, accepting unverified clients, or ignoring forged documents will face immediate termination with cause and potential referral for criminal prosecution.
